Blue Ridge GA City Limits: Short-Term Rental Rules Before You Buy

October 8, 2026

"I relied in good faith on those approvals," Austin Vest told the Blue Ridge City Council on August 18. He was talking about the county permits his builders had pulled for the house at 66 Mountain Tops Circle. "About a week after moving in, I learned that the process should have started with the City of Blue Ridge. Fannin County Land Development acknowledged its role in the mistake."

Vest told the council he had bought the property to use as a vacation rental. The News Observer reported that this use is not allowed on that property within city limits. So the house had been permitted by one government, sat under the rules of another, and was meant for a use the second government doesn't allow there. If you plan to rent out a Blue Ridge cabin part of the year, this case shows the order your due diligence has to follow. Settle jurisdiction first. Then zoning. Only then does the rental math matter.

A Parcel Number That Looked Like the County's

Fannin County Attorney Lynn Doss explained to commissioners that the parcel lies partly in the county and partly in the city. "The house is on the city's side, the taxation is such that it didn't have a BR parcel number and was not readily identified as being a city parcel when it was purchased," she said. City meeting records list the property as parcel 0053B 00102. Vest described it as a Fannin County parcel ID "rather than the typical BR ID for Blue Ridge properties," and asked to have it corrected.

That BR prefix is a habit people rely on, not an official boundary test. The county's qPublic search portal does not explain the prefix or say that it marks municipal limits. Buyers, builders and county staff all moved forward on this parcel without catching the city line. For you, the takeaway is simple. A tax record that reads like a county parcel doesn't prove the property is in the county.

Fixing it has been slow and public. The house needed a front setback of 19.5 feet where the city requires 30, and a height of 35 feet where the limit is 30. The city's staff analysis, prepared by City Clerk and Zoning Administrator Jennifer Bates and Planning Consultant Eric Soroka, recommended denying the setback variance and approving the height variance. The council approved both, 4 to 1. Councilman Bubba Gibbs voted no, citing concerns about how narrow the road is. The News Observer reported that county commissioners then voted for de-annexation, which state law requires before the city can vote. The city's posted summaries for its September 8 workshop and September 17 council meeting show no follow-up action on the property. As of early October 2026, the de-annexation is still unfinished.

One Sentence in the City Code Does Most of the Work

The News Observer's phrase "not allowed within city limits" is shorthand. The real rule is narrower, and for buyers it matters more. Section 10-193 of the Blue Ridge Code says short-term vacation rentals "may be offered to the public for rental only on properties zoned Central Business District (CBD)."

So inside the city, the question isn't whether rentals are allowed. It's which zoning district the parcel is in. A cabin on a residential street inside the line and a condo in the downtown core are in the same city but sit on opposite sides of this rule. That gap shapes our guidance on condos and townhomes near downtown Blue Ridge, where the zoning district often matters more than the floor plan.

The code defines a short-term rental as a stay of 30 consecutive days or less. It excludes homes offered for rent fewer than 14 days in a calendar year. Even on CBD land, an owner needs a city short-term rental certificate and an occupation tax certificate, must pay all applicable state and city taxes, and pays a $100 annual permit fee. Renting without a certificate carries a minimum $250 fine, and each occurrence counts as a separate offense.

Why the Seller's Rental History May Stop at Closing

Plenty of buyers miss this part. A city property that is renting today, with reviews and a booking calendar, may not be able to rent for its next owner.

The city grandfathered rentals that were already operating outside eligible zones and paying hotel/motel tax. That protection lasts only "until there is a change in ownership of said property." The exception is land zoned C-1 or C-2, where operation can continue after a sale. A C-1 or C-2 property can also qualify if a building permit was applied for before January 1, 2023. City certificates also don't transfer. If ownership changes, the new owner has to file a new application and pay the fee.

The result is that two city cabins with identical rental histories can face very different futures at closing, depending on their zoning. Unincorporated Fannin County works on a different system. Here is how the two compare:

City of Blue Ridge Unincorporated Fannin County
Where new rentals can operate CBD-zoned property only Covered rentals with a county certificate
Certificate cost $100 annual permit fee $225 new certificate; $50 owner-transfer fee
After a sale Grandfathered use outside eligible zones ends, except C-1 and C-2 New owner files a transfer
Penalty for renting without a certificate Minimum $250 per occurrence Up to $1,000 per day
Property tax, FY2026 City 3.862 mills plus county and school rate County and school rate of 8.918 mills

The county rules come from Ordinance 2025-02, revised August 26, 2025. It covers rentals in unincorporated areas and in cities the county administers, and sets a 6% lodging tax that has to be reported and paid by the 20th of each month. Fannin County's short-term rental application packet asks for a deed, occupancy and bedroom details, an emergency worksheet, and a local contact who can reach the rental within two hours. The city's ordinance register lists its short-term rental amendments as BR2022-05 and BR2023-04, with no later change.

On taxes, the city adopted a 3.862-mill rollback rate for fiscal year 2026 and bills its own property taxes using assessments from the county assessor. Fannin County's combined county and school rate for 2026 was finalized at 8.918 mills: 2.401 for the county and 6.517 for the Board of Education. When you model a cabin's carrying costs, the city line affects your tax bill as well as your rental income.

How to Confirm Jurisdiction Before You Write an Offer

Mountain Tops shows that a listing, a tax record and even a county permit can all point the wrong way. Our Blue Ridge due diligence checklist covers the full process. For rentals, this part comes first:

  1. Screen with the city's zone districts map. The city-hosted "Blue Ridge Zone Districts" map shows a city limits layer and the zoning categories R-A, R-1, R-2, R-3, C-1, C-2, CBD and M-1. The page shows no date, and some of its district labels differ from the current code, so use it for screening, not as a final answer.
  2. Don't rely on qPublic for the boundary. Fannin's qPublic viewer is useful for parcel lines, roads, subdivisions, sales, soils and streams, but it doesn't list a city limits or city zoning layer.
  3. Get the answer from the City Clerk. The official zoning district map is kept on file with the City Clerk. Jennifer Bates, City Clerk and Zoning Administrator, can be reached at 706-946-2440. Kelsey Ledford, Planning, Zoning and Permitting Clerk, is at 706-946-2434.
  4. If the parcel is in the city, ask the zoning question directly. Is it zoned CBD? If not, is it C-1 or C-2? Is there a current certificate, and will it survive a change in ownership?
  5. Check which government issued the permits. If a city parcel was built under county approvals, setbacks and height may need review, as happened at 66 Mountain Tops Circle.
  6. Build your contingency around the answer. Remote buyers can get these confirmations during the due diligence period. Our guide for remote buyers shopping Blue Ridge cabins explains how to schedule that work.

Treat all of this as research to confirm with the city and county, not as legal advice. For anything unusual, ask a Georgia real estate attorney.

What Sellers Should Have Ready

If you're selling a cabin that rents, buyers' agents will ask these same questions, so have the answers ready. Confirm the parcel's jurisdiction and zoning with the City Clerk before you list. Collect your certificate, your lodging tax filing history and your permit records. If the property is inside the city and outside CBD, C-1 and C-2, describe its rental history accurately and don't suggest it will continue. A buyer who learns about the grandfather rule during due diligence is far more likely to renegotiate or walk away. If you're weighing how rental eligibility affects your list price, a home valuation is a good place to start. Our guide to buying a vacation rental cabin in Blue Ridge covers the buyer's side of the same conversation.

FAQ

Is short-term renting banned everywhere inside Blue Ridge city limits? No. City Code Section 10-193 allows short-term rentals on property zoned Central Business District, with a city certificate, an occupation tax certificate and a $100 annual fee.

Does a parcel number without "BR" mean the property is in the county? Not reliably. 66 Mountain Tops Circle carried parcel number 0053B 00102 and still had its house on the city side of the line.

Can I rent a home occasionally without a certificate? Under the city's definition, a home offered for rent fewer than 14 days in a calendar year is not a short-term vacation rental. County rules are separate, so ask Fannin County directly about a county parcel.

Is the Mountain Tops de-annexation final? Not as of the city's September 17, 2026 meeting summary, which lists no action on the property.
